Modify some articles in the Intellectual Property Law
On April 10, the Standing Committee of the National Assembly met and commented on the addition and amendment of some articles of the Intellectual Property Law, focusing mainly on patent protection and geographical indication and sanctions for infringement of intellectual property rights to be consistent with Vietnam's commitments in the CPTPP Agreement.

It is expected that these new regulations will take effect immediately after being approved by the National Assembly.

In general, new regulations tend to create more conditions for those who want to register for intellectual property protection.

This is reflected in the novelty of the invention still recognized even when disclosed, expanding the criteria to protect geographical indications and trademark protection (in the past, trademarks were only signs can be seen with the eyes, now open more are sound signs) or now, people can apply for an online industrial trademark.

In addition, the organization of individuals who arraign due to infringement or abuse of intellectual property rights will not only have to pay damages to the plaintiffs but also have to pay the cost of hiring lawyers.

However, these new regulations may be disadvantageous for Vietnam when most of our enterprises are not inclined to consider the registration of intellectual property as their competitive advantage.

The Deputy Minister of Science and Technology said in the meeting, these amendments only keep up with a number of commitments under the CPTPP urgently required by the National Assembly in Decree 72, dated 12/11/2018 .

In addition, there are many other contents related to CPTPP, but the implementation period is longer, within 3-5 years and the irrationalities in the Intellectual Property Law will be proposed in the amended Intellectual Property Law. It is expected to submit to the National Assembly in 2021.
